SpinNet Service AIR-EDGE Agreement SOFTBANK TELECOM Corp. SOFTBANK TELECOM Corp. (hereinafter called " SOFTBANK TELECOM") will provide SpinNet Service AIR-EDGE (hereinafter called "the Service") in accordance with the SpinNet Service AIR-EDGE Agreement (hereinafter called "the Agreement") with SpinNet Service Customers (hereinafter called "the Customer"). Article 1. (Applicable Legal Provisions) We will provide SpinNet Service in accordance with the provisions of the Telecommunications Business Law (Law No. 86 of 1984; hereinafter called "the Law"), and regulations of other laws. SpinNet Service will be available through AIR-EDGE service which is provided by WILLCOM, Inc.. Article 2. (Revision of the Agreement) We may revise this Contract without obtaining the consent of the subscriber. If this Contract is revised, the service charges and other service conditions shall be governed by the revised SpinNet Service Contract. Article 3. (Subscription Agreement Unit) A subscription agreement for SpinNet Service shall be concluded for each user ID used by the subscriber. Article 4. (Application for Subscription) Any Customer who desires to subscribe to AIR-EDGE provided by WILLCOM Inc. shall register to the service from the SpinNet homepage. Article 5. (Cancellation of the Service by the Customer) When the Customer cancels the SpinNet Service, the Customer shall notify the Company to cancel the Service. Article 6. (Charges, etc.) For charges of the Service refer to the SpinNet Service Agreement. Article 7. (Terms and Conditions) Except for the obligation as stated in the Agreement and the SpinNet Service Agreement, the Company does not assume any responsibility for any damage that the Customer may suffer from the use of the Service. 2. If there are any discrepancies between the Japanese Agreement and the English Agreement, the Japanese Agreement will be used to settle all disputes. Supplementary provision: 1. The Agreement is established on December 14, 2001 This Agreement is revised on February 2, 2005 This Agreement is revised on April 1, 2005 2. JENS Corporation changes its corporate name to JAPAN TELECOM CO., LTD.@Customers who had concluded the agreement with us before March 31, 2005 do not need to conclude the agreement again. Additional Rules (Enforcement Time) 1. This Agreement is revised on October 1, 2006. (Change of Name of JENS SpinNet Service Agreement) 2. On the day this Agreement is revised, JENS SpinNet Service Agreement will be changed to SpinNet Service Agreement. (Interim Measures with regard to JENS SpinNet Service) 3. The subscription agreements for JENS SpinNet Service presently existing as of this revision that were concluded pursuant to the provisions of JENS SpinNet Service Agreement before this revision will be deemed to be subscription agreements for SpinNet Service concluded by SOFTBANK TELECOM pursuant to the provisions of this Agreement after revision as of the day this Agreement is revised.
